These Terms of Use ("Terms") govern your access to and use of iStocker.shop, including our website, online storefronts, applications, tools, features, and related services.
By accessing or using iStocker, creating an account, operating a storefront, purchasing products, or otherwise using our services, you agree to be bound by these Terms and any policies incorporated into them.
If you do not agree with these Terms, you should not use iStocker.
iStocker is a digital commerce platform that provides businesses with tools to create and manage online storefronts, products, customers, orders, payments, shipping, digital products, and other commerce activities.
Unless expressly stated otherwise, businesses using iStocker operate their own independent storefronts and are responsible for the products and services they offer to their customers.
iStocker provides the technology and infrastructure that enables these activities but does not automatically become the seller of products offered by independent businesses.
You must be at least 18 years old and legally capable of entering into binding agreements to create and operate a business account on iStocker.
By using iStocker, you confirm that you meet these requirements and that the information you provide is accurate.
Some iStocker features require you to create an account.
You are responsible for:
You must not create an account using another person's identity or impersonate another person, business, organisation, or brand.
Businesses may use iStocker to create and manage one or more storefronts, subject to the applicable subscription, eligibility, verification, and platform requirements.
Businesses are responsible for ensuring that their business information is accurate and lawful.
This includes information such as:
We may request additional information or verification where reasonably necessary to protect the platform, comply with legal requirements, prevent fraud, or enable particular services.
Businesses operating storefronts on iStocker are responsible for their own commercial activities.
This includes responsibility for:
Businesses must provide customers with any legally required information about their products, business, payment arrangements, shipping, returns, refunds, and other commercial terms.
Businesses may list physical products, digital products, services, or other permitted offerings through iStocker.
Businesses are solely responsible for ensuring that products and services they offer comply with applicable laws, regulations, licensing requirements, payment-provider rules, and iStocker's Acceptable Use Policy.
iStocker may remove or restrict products that violate applicable law, our policies, payment-provider requirements, or platform rules.
Businesses offering digital products must have the necessary ownership, licences, permissions, and rights to distribute those products.
Digital products may include software, documents, books, courses, templates, graphics, audio, video, or other downloadable content.
You must not use iStocker to distribute pirated, stolen, unlawfully obtained, or copyright-infringing digital content.
iStocker may provide businesses with tools for managing customers, customer information, orders, addresses, shipping information, and transaction records.
Businesses are responsible for using customer information lawfully and in accordance with applicable privacy and data-protection requirements.
Customers are responsible for providing accurate information required to complete their orders, including appropriate contact and delivery information.
An order placed through a storefront represents a transaction between the customer and the relevant business unless iStocker expressly states otherwise.
Businesses are responsible for fulfilling accepted orders in accordance with their stated terms and applicable law.
iStocker may provide order-management and transaction functionality but does not guarantee that a particular product will remain available or that a business will fulfil an order.
iStocker may support payment processing through third-party providers, including payment services such as Stripe, Paystack, or other supported providers.
Depending on the configuration of a business, payments may be processed through an iStocker-supported payment arrangement or through a payment gateway configured by the business.
Businesses are responsible for maintaining valid payment configurations and complying with the terms and requirements of their selected payment providers.
Payment providers may impose additional restrictions on businesses, products, transactions, currencies, territories, or payment methods.
Certain iStocker features and services may require a paid subscription or other applicable fees.
We may change subscription plans, pricing, features, or billing arrangements from time to time. Where required, we will provide appropriate notice of material changes.
Refunds for products purchased from an independent business are generally governed by that business's own refund, return, and cancellation policies, subject to applicable consumer-protection law.
Refunds relating to iStocker subscriptions or services provided directly by iStocker are governed by the applicable iStocker refund terms.
Businesses are responsible for configuring appropriate shipping, delivery, pickup, and fulfilment arrangements for their storefronts.
Where a business restricts shipping to particular countries, territories, states, cities, or other locations, customers may only be able to select eligible delivery locations.
Delivery times, shipping charges, pickup arrangements, and fulfilment obligations may vary between businesses.
Users may upload or provide content to iStocker, including product information, images, videos, documents, digital products, logos, descriptions, and other materials.
You retain ownership of content that you own and upload to iStocker.
By uploading content, you grant iStocker the permissions reasonably necessary to host, store, reproduce, display, transmit, process, and deliver that content as required to provide and operate the services.
You are responsible for ensuring that you have all necessary rights and permissions for content you upload.
iStocker and its underlying technology, software, platform design, branding, trademarks, logos, interfaces, documentation, and other proprietary materials are owned by or licensed to iStocker and are protected by applicable intellectual property laws.
Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, or create derivative works from iStocker's proprietary technology or materials.
Your use of iStocker is also subject to our Acceptable Use Policy.
You must not use iStocker for illegal activities, fraud, malicious activity, intellectual property infringement, unauthorised access, abuse, or any other activity prohibited by our Acceptable Use Policy.
Our collection and use of personal information is described in our Privacy Policy.
Businesses using iStocker may also have independent responsibilities regarding personal information collected from their customers.
Where a business controls the purposes for which customer information is processed, that business may act as the relevant data controller for those activities.
We may suspend, restrict, or terminate an account, storefront, product, payment functionality, or other platform access where reasonably necessary.
This may occur where:
Where appropriate and legally permitted, we may provide notice before taking enforcement action.
You may close your iStocker account subject to any applicable requirements.
Following account closure, information associated with your account or business may be deleted or anonymised in accordance with our Privacy Policy and applicable retention requirements.
Certain information may need to be retained where required or permitted by law, including information relating to financial records, transactions, fraud prevention, disputes, legal obligations, or security.
Closing a business account does not automatically eliminate obligations relating to transactions that occurred before closure.
iStocker may integrate with or rely on third-party services, including payment providers, hosting providers, authentication services, analytics services, communication services, and other infrastructure providers.
Your use of third-party services may be subject to the relevant provider's own terms and policies.
iStocker is not responsible for the independent operation or policies of third-party services.
We aim to provide reliable and secure services, but we do not guarantee that iStocker will always be available, uninterrupted, error-free, or free from delays.
Services may occasionally be unavailable because of maintenance, upgrades, technical problems, security incidents, infrastructure failures, third-party service interruptions, or circumstances beyond our reasonable control.
We may modify, improve, add, remove, suspend, or discontinue features of iStocker from time to time.
We may also introduce new services, features, subscription plans, limits, or requirements.
Where a change materially affects an existing paid service, we will provide notice where required by applicable law or the applicable agreement.
To the fullest extent permitted by applicable law, iStocker provides the platform and its services on an "as available" and "as is" basis.
We do not guarantee that:
To the fullest extent permitted by applicable law, iStocker will not be liable for indirect, incidental, special, consequential, or punitive losses arising from or relating to your use of the platform.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
Nothing in these Terms is intended to limit any statutory consumer rights that cannot lawfully be excluded.
To the extent permitted by applicable law, businesses and other users agree to be responsible for losses, claims, liabilities, costs, and reasonable expenses arising from their unlawful use of iStocker, violation of these Terms, infringement of third-party rights, or products and services they offer through the platform.
These Terms shall be governed by and interpreted in accordance with the laws of England and Wales, unless applicable law requires otherwise.
Any disputes shall be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights or protections available to consumers under applicable law.
We may update these Terms from time to time to reflect changes to our platform, services, business operations, technology, or legal requirements.
When we make material changes, we will take reasonable steps to notify users where required.
The updated version will be published on this page with a revised "Last Updated" date.
If any provision of these Terms is determined to be invalid, unenforceable, or unlawful, the remaining provisions will continue to apply to the fullest extent permitted by law.
These Terms, together with the Privacy Policy, Acceptable Use Policy, Cookie Policy, applicable Merchant Terms, and any other agreements expressly incorporated into these Terms, form the agreement governing your use of the relevant iStocker services.
